MULLIN J:

This matter comes before the Commission on the Appeal of the State of Nebraska on the ruling of the Special Master dated February 8, 1988.

The hearing on the Appeal was held on March 31, 1988 by consent of the parties, by telephonic conference in which counsel for the parties were present in the Commission's office with the court reporter and Judge Mullin was in Scottsbluff, Nebraska connected by telephone hookup.

Evidence was offered, argument presented, and the Appeal submitted.

The Commission finds that only one final offer was offered into evidence before the Special Master which final offer must be approved in this Appeal under the mandates of Section 81-1383 R.R.S. (1987).

It is therefore ORDERED that the ruling of the Special Master is affirmed and that the relief sought by this Appeal is denied.
