v. | FINAL ORDER
|
NEBRASKA STATE PATROL, |
|
Respondent. |

Before: Judges Cullan, Mullin, Kratz, Orr and Cope (EN BANC)

CULLAN, J:

This matter came on for hearing on Petitioner's Motion for Post-Trial Conference and Motion for New Trial under Section 48-816(7)(d)(R.R.S. 1943) on October 9, 1986. The parties were represented by their counsel of record: J. Murry Shaeffer for the Petitioner and Charles Lowe, Steven Shaw and William Harding for the Respondent.

Petitioner contends that the Commission erred in finding that it did not have jurisdiction of the case pursuant to LB 1250.

We do not agree and decline to find error in the Findings and Order of September 18, 1986. Moreover, we affirm our position previously stated in the Order of July 1, 1986 and the Memorandum of July 24, 1986.

IT IS THEREFORE ORDERED that the Findings and Order shall stand as issued by the Commission on September 18, 1986.

Entered October 10, 1986.
