Before: Judges Orr, Kratz, and Davis.

ORR, J:

Now on this 28th day of June, 1983 this matter came on for hearing upon Plaintiff s Motion for Rehearing. The Plaintiff was represented by L. Bruce Wright. The Defendant was represented by M. H. Weinberg. Both parties presented oral argument.

The Commission being duly advised in the premises finds that:

1. Plaintiff's Motion should be overruled.

2. That Table 7, page 41 of the original opinion should be modified to include the dollar contribution from the employer as set out in Plaintiff s Exhibit 51A.

3. The wage order entered did not take into consideration summer school or overload pay.

4. The Commission found all other conditions of employment to be comparable to the prevalent.

5. That the original opinion is amended to correct a typographical error which appears in the final paragraph on page 7 continuing onto page 8. This paragraph should read:

The final case in the New Jersey trilogy, Bd. of Ed. Englewood v. Englewood Teachers, 64 N. J. 1, 311 A.2d 729 (1973), provided that: "***major educational policies which indirectly affect the working conditions of the teachers remain exclusively with the Board and are not negotiable whereas items which are not predominantly educational policies and directly affect the financial and personal welfare of the teachers do not remain exclusively with the Board and are negotiable."

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED THAT:

1. Plaintiffs motion for rehearing is overruled.

2. That the original opinion entered on June 7, 1983 is hereby modified to conform with the above.

Filed June 30, 1983.
