Before: Judges Kratz, Orr, and Gradwohl

KRATZ, J:

This matter comes before the Commission on Petitioner's Petition and Application for Temporary Order in which Petitioner moved the Commission for a Temporary Order directing the Respondent to undertake good faith negotiations with the Petitioner on the matter of mileage for use of private vehicles while performing official business. The Petitioner was represented by its attorney, Theodore L. Kessner. The Respondent was represented by its attorney, John F. Recknor.

The Commission being duly advised in the premises finds that the payment of mileage for use of private vehicles while performing official business is a mandatory item of negotiation.

IT IS THEREFORE ORDERED that the Respondent be, and hereby is, ordered to undertake good faith negotiations with the Petitioner concerning the matter of payment of mileage for use of private vehicles while performing official business as it relates to the 1984-85 contract year.

The Commission intends to issue no further Order in this matter since the prayer for relief contained in the Petitioner's Petition is substantially the same as in Petitioner's Application for Temporary Order.

All Judges assigned to the panel in this case join in the entry of this Order.

Filed August 10, 1984.
