COUNCIL, J.

NATURE OF THE PROCEEDINGS:

Cedar Canyon Education Association (hereinafter, "Petitioner" or "Association") filed a wage petition on April 9, 2002, seeking resolution of an industrial dispute for the 2001-2002 contract year. The Association is a labor organization formed by teachers employed by Scotts Bluff County School District No. 79-0060, a/k/a Cedar Canyon Public Schools (hereinafter, "Respondent" or "District") for the purpose of representation in matters of employment relations. The District is a political subdivision of the State of Nebraska and a Class I school district. The Respondent employed 9 staff members with an FTE of 8.5 for the 2001-2002 school year.

The Commission of Industrial Relations (hereinafter, "Commission") held a Pretrial on May 21, 2002. At Pretrial, the parties submitted this case on the record. Petitioner introduced Exhibits 1-9, which were received into evidence without objection. Respondent presented no evidence. Base pay was the only term and condition of employment at issue.

BASE SALARY:

Based entirely on the Petitioner’s Exhibits received at pretrial, Table 1 sets forth the relevant information for determining the appropriate base salary. The midpoint of the total compensation $300,982 minus the cost of fringe benefits $25,858 equals $275,124, which, when divided by the new total staff index factor of 11.9000, equals a base salary of $23,120 for the 2001-2002 school year.

IT IS THEREFORE ORDERED THAT:

    1. Respondent shall pay the teachers a base salary of $23,120 for the 2001-2002 school year.
    2. All other terms and conditions of employment for the 2001-2002 school year shall be as previously established by the agreement of the parties.
    3. Adjustments in compensation resulting from this Order shall be paid in a single lump sum with the payroll checks issued next following issuance of this final order.
