COPE, J:

This matter came on for hearing before the Honorable Thom K. Cope upon Respondent's Request for Post-Trial Conference. The hearing was held on May 21, 1990. The Petitioner was represented by Mark D. McGuire and the Respondent was represented by Rex Schultze.

The Respondent alleged that the Commission erred in not including the fringe benefit cost in arriving at base salary.

To do as the Respondent requested would be to use speculative health benefit costs attributed to the Respondent and the Commission will not do so. Upon review of the record and in contemplation of the parties' arguments, the Commission finds that the recommended Findings and Order should remain unchanged.

IT IS THEREFORE ORDERED that the recommended Findings and Order of May 3, 1990 remain as issued.

All judges assigned to the panel in this case join in the entry of this Final Order.
