PEETZ, J:

This matter came on for hearing before the Honorable John P. Peetz upon Respondent's Motion for Post-Trial Conference. The hearing was held on the 1st of August, 1988, in the Commission Hearing Room. The Petitioner was represented by Mark D. Mcguire and the Respondent was represented by John F. Recknor.

The Respondent alleged that the Commission either erred in 1) failing to include Holt 2 (Page) in the array, or 2) using any of Petitioner's evidence as it was violative of the hearsay rule. Upon review of the record and in contemplation of the parties' arguments the Commission finds that the recommended Findings and Order should remain unchanged.

IT IS THEREFORE ORDERED that the recommended Findings and Order of July 14, 1988, remain as issued.

All judges assigned to the panel in this case join in the entry of this Final Order.

Entered August 2, 1988
